RELEASE/WAIVER OF LIABILITY. Member agrees to release and discharge the Club, including its affiliated companies, shareholders, officers, directors, employees, representatives and agents or other associated parties, from any and all liability that may arise from a loss, claim, injury, damage, demand or cause(s) of action resulting from death, personal injury, loss of stolen property, or any other damage arising out of Member’s participation in any sport, physical exercise or other activity in connection with Member’s use of the services, equipment, and facilities at this Club or a reciprocal Hidden Gym Club.

ASSUMPTION OF THE RISK. Member understands and acknowledges that participation in a sport or physical exercise may result in an accident or injury, and MEMBER EXPRESSLY AND VOLUNTARILY ASSUMES THE RISK OF PERSONAL INJURY OR DEATH SUSTAINED WHILE PARTICIPATING IN A SPORT OR PHYSICAL EXERCISE at this Club or a reciprocal Hidden Gym Club. Furthermore, Member represents that Member is in good health and suffers from no impairment that would prevent Member’s use of the Club’s facilities. Member understands and acknowledges that the Club has not and will not render any medical services including medical diagnosis of Member’s physical condition. Member further agrees that all exercises, including but not limited to the use of weights, number of repetitions, and the use of any and all machinery, equipment, facilities, and apparatus will be AT MEMBER’S SOLE RISK.

INDEMNITY AGREEMENT. Regardless of any consultation or exercise program which may be provided by the Club’s employees. It is understood that the selection of exercise programs, methods, and types of equipment shall be the entire responsibility of Member, and therefore Member agrees to Indemnify and hold the Club Harmless from any losses, claims, injuries, damages, judgments, costs or causes of actions that arise from Member’s own actions, even negligence, that may cause death or injury to Member’s person or property in connection with Member’s use of the services and facilities of the Club or the premises where the Club is located.

USE OF FACILITIES BY MINOR. If the Club grants permission for a minor child to use the facilities, minor’s Parent/Guardian agrees to be solely responsible for any and all damages to the Club’s premises or equipment resulting from that use. Parent/Guardian also assumes sole responsibility for any injury or death to Parent/Guardian’s child from that use of the Club’s facilities or equipment.
